TSA Tightens Security for Hop-On Charter Flights

Measures Affect Part 380 Carriers Like JSX and Aero

The Transportation Security Administration (TSA) has proposed new rules requiring stricter security screening for passengers on Part 380 "hop-on charters". This affects public charter carriers like JSX, Aero, and XO.

The changes fall under the Twelve-Five Standard Security Program (TFSSP), which is related to by-the-seat flights on aircraft over 12,500 pounds. These currently bypass traditional airport terminals by departing from FBOs or private hangars. The new measures, however, will bring screening for passengers, carry-on luggage, and personal items up to airline standards. This is set to take effect 180 days after issuance.

“Following a security risk assessment, which considered the operations, existing security measures, and other relevant details, TSA issued a new requirement that all public charter operators screen passengers in accordance with the Persons and Accessible Property (PAP) screening requirements when they are conducting public charter operations,” the agency stated.

Part 380 carriers, which have marketed themselves as offering streamlined travel and minimal wait times, will now have to purchase equipment, train staff, and potentially expand facilities. This could pose challenges for airports and FBOs with limited space, especially since they’ll only have 180 days to prepare.

The changes have been met with resistance from carriers and industry groups. JSX CEO Alex Wilcox has criticized the regulations as anti-competitive, alleging they are driven by pressure from major airlines and unions. Seven organizations also wrote to the FAA in 2023 to oppose a similar Part 380 policy change.

“In an industry where four major airlines control more than 80% of the domestic market, Part 380 provides much-needed competition in a highly concentrated marketplace, often ensuring secondary markets and small communities continue to have options for meeting the air transportation needs of their citizens,” their letter stated.

The FAA and TSA have shown concerns about the rapid growth of public charter services, pointing out how they’re looking more and more like Part 121 airline operations due to their scheduled nature and partnerships with major carriers.
