Lewes, DE Scraps Plans For Drone Regulations

State Law Prevents Passage Of Local Rules, City Attorney Says

The city of Lewes, Delaware has shelved plans to regulate the use of UAVs in the city after learning such rules would violate state laws.

The Cape Gazette reports that, according to Lewes City Solicitor Glenn Mandalas, the state specifically prohibits cities from creating its own rules regarding the use of unmanned aircraft. The state code says a municipal government body is not allowed to enact laws that "prohibit, restrict or regulate the use of unmanned aircraft."

What cities in Delaware can do is pass laws that might be applied to the use of drones, such as privacy, nuisance and noise regulations.

Mandalas told the paper that some are opposed to the state's moratorium on local ordinances regulating drone use, arguing that local governments have the best handle on what regulations might address specific issues concerning drones in their cities.
