The Commercial Drone Alliance has called for Congress to repeal Section 336 of the FAA Modernization and Reform Act (FMRA) of 2012.

Since the implementation of the FAA’s Part 107 in 2016, which broadly authorized commercial drone operations in the U.S., drone use has been growing at an exponential rate. CDA claims that Section 336 of the 2012 FMRA currently prohibits the FAA from regulating qualifying model aircraft. CDA alleges that this exemption has been misinterpreted and abused—giving all model aircraft users, including those not participating as part of a Community Based Organization as required under the law, the mistaken impression that they are flying legally. In a response, the AMA defended Section 336, saying eliminating the language would mean more work for an already-overburdened FAA. In October 2017, the FAA deployed LAANC (pronounced “LANCE”) at several air traffic facilities to evaluate how well the prototype system functioned for drone operators who want to fly in controlled airspace and for the facilities themselves. The FAA is now considering agreements with additional entities to provide LAANC services. The period for new entities to apply will run from April 16 to May 16, 2018. A team led by Southwest Research Institute (SwRI) is developing unmanned aerial system (UAS) technology to fly into the containment vessels of the damaged units at Japan’s Fukushima Daiichi nuclear power station and assess conditions.
