O'Hare Expansion Survives Legal Challenge... So Far

Score another victory for Chicago O'Hare... It survived yet another court challenge to plans for a major expansion, that includes moving a 157-year old religious cemetery and destroying hundreds of homes. The US Court of Appeals in Washington, Friday ruled 2-to-1 in favor of the expansion.

But the city of Chicago may still be on the hook in the wake of that ruling which says, the FAA isn't violating anyone's religious freedom by planning to move the cemetery. The three-judge panel says Chicago is the sole author of this plan, and if anyone wants to fight in court about it, they should go after Chicago -- NOT the FAA.

Opponents of moving St. Johannes Cemetery say plans to move the cemetery violate the Religious Freedom Restoration Act, and would prevent the physical ressurection of those who are buried there.

On a more earthly note, officials in nearby towns opposed to the airport's expansion say they'll appeal Friday's ruling. Elk Grove Mayor Craig Johnson calls his challenge to O'Hare a 15-round title fight.

Sure, he says, he's lost 13 rounds so far... but he's still hoping for a knock out that will make sure no homes in his community are destroyed.
