US Supreme Court Won't Review Mandatory Pilot Retirement

Justices Refused To Hear Challenge FAA's 60-Year Old Retirement Rule

The US Supreme Court Monday refused to hear arguments from pilots challenging mandatory retirement age for airline pilots.

The suit, brought by a dozen pilots with the backing of Southwest Airlines, had challenged an FAA rule in effect since the 1950s -- a rule that says airline pilots must retire by age 60.

In its friend-of-the-court brief, Southwest agreed heartily, saying older pilots "as safe as, and in some cases safer than, their younger colleagues. The 1950s-era age 60 rule, coupled with the FAA's rigid implementation of it, arbitrarily deprives Southwest Airlines of some of its best pilots at the peak of their careers."

Justices rejected the case without comment.
