An Appeal Has Been Filed Against A Court Injunction That Prevented The Town From Limiting The Number Of Flights

The town of East Hampton has attempted to limit helicopter flights into their community by restricting the flights to only once per week, and by imposing a curfew for the operation. A court action filed by opponents to the laws resulted in a court ruling whereby the morning and evening curfew was upheld, but the limitation of the number of flights was not.

The two curfew limitations went into effect early in early July but an injunction was placed on the town preventing them from implementing the law restricting helicopter flights to one time per week.

It has been reported on the website, southoldlocal.com, that the town of East Hampton has now taken the step of appealing the Supreme Court injunction to allow the once-a-week limitation to be placed into effect.

According to the report, East Hampton Town Supervisor Larry Cantwell said. “These three laws are the result of careful, thoughtful and transparent balancing by the town board. We are hopeful that the Court of Appeals will recognize that all three laws are essential to address the problem of excessive aircraft noise.”

As reported earlier by ANN, the NBAA is taking a stand in this matter. In our earlier report, Steve Brown, NBAA chief operating officer said, "As a public-use airport receiving federal funds, East Hampton is bound by grant assurances and other regulations that require it to operate within compliance with federal aviation law and policy."
