Atlantic Aviation Works To Stave Off Eviction From KSMO

Cease And Desist Order Request Filed Against City Of Santa Monica

While aviation associations and other groups keep up the pressure on the FAA and the City of Santa Monica over the looming eviction of two FBOs on the airport, one of those businesses is also fighting to stay on the premises.

Atlantic Aviation filed a motion for a Cease and Desist order against the city with the FAA's chief counsel on September 19. In the filing, the company says the agency "has the authority to issue interim cease and desist orders" in such cases. The company reiterates that the city is in violation of its federal obligations, and that eviction will irreparably harm Atlantic Aviation and the flying public.

The 30-day Notice to Vacate was sent to Atlantic Aviation on September 15, 2016, by the City of Santa Monica. The city has been working to close the airport and convert the land into a park. The city filed eviction notices against Atlantic Aviation and American Flyers, saying the city was going to take over fuel concessions and other FBO operations at the airport. The city reportedly planned to sell only biofuel and unleaded aviation gasoline at the airport, rather than traditional avitation fuels, it said in an effort to address environmental concerns of nearby residents.

The NBAA, AOPA, NATA, and other aviation associations have been supporting the FBOs in an effort to prevent their eviction.
