Atlantic Aviation Seeks Cease And Desist Order Against Santa Monica

Hopes To Stop Eviction While Part 16 Complaint Is Considered By The FAA

Atlantic Aviation has filed a cease and desist motion from the FAA to stop its eviction from Santa Monica airport (KSMO).

In the motion sent to the FAA on September 19, Atlantic says that the order is necessary and appropriate because the eviction notice from the City delivered September 15 is in violation of the city's federal obligations, as demonstrated in Atlantic's Part 16 Complaint.

"Permitting the City to evict Complainant while the Complainant's claims are pending before the FAA would irreparably harm Complainant, all aviation users of the airport, and would undermine the FAA's exclusive authority to ensure safe and efficient use of national airspace and enforce airport grant assurances and other federal obligations," the motion states.

Atlantic says in its motion that it is "highly likely to prevail on the merits of its Part 16 complaint," and asks for a quick response from the FAA.
