Linear Air Alleges New Violations, Possible Threats By Jettly, OneFlight

Charter broker Linear Air is alleging that three of its competitors have responded to complaints it filed with the U.S. Department of Transportation (DOT) with potentially retaliatory threats of their own.

During the week of November 26, 2024, Linear Air filed complaints against Jettly, OneFlight International, and Surf Air, saying the three displayed charter pricing that violated Part 295 governing charter brokers, and Part 399.84, which requires advertised prices for air transportation to be the entire price to be paid by the customer. Linear Air’s complaint alleged that the pricing did not include taxes.

After the filing of those complaints, Linear Air CEO William Herp says that emails he received from Jettly and OneFlight were “possible retaliatory acts.”

Herp said in a letter to the Office of the Inspector General that the emails from the other brokers “represent an act that threatens our livelihoods as the complainant and is a possible violation of 18 USC Section 1513 (e) and other statutes.”

In a follow-up email to the DOT, Herp made new allegations, saying, “It is our understanding that Jettly does not have a Part 135 authorization and may be misrepresenting that they do by promoting a fleet. In addition, the pricing included in the email is unclear as to whether it includes fees and taxes.”

The three brokers named in Linear Air’s complaints stated they have done nothing wrong, and they do not believe they are threatening Linear Air’s operations in any way. In fact both Jettly and OneFlight have said they believe Linear Air is in the wrong and have engaged counsel in consideration of pursuing legal action against Linear Air.
