Gol/ExcelAire MidAir Draws More Legal Attention

Law Firm Sues ExcelAire and Honeywell For 'Negligence'

One of the most divisive international aircraft accidents has just gotten more so... this time due to the attention paid it by yet another law firm claiming to be one of the best in the field, etc., and placing blame long before any investigative body plans to offer a probable cause.

A US law firm, Lieff Cabraser Heimann & Bernstein, LLP, has hit the PR mill with their announcement of law suits on behalf of a total of 21 passengers on Gol Airlines Flight 1907 who were killed after the aircraft collided with an aircraft owned and operated by ExcelAire Service, Inc. have filed suit against ExcelAire and Honeywell International Inc.

In the new lawsuit filed in a New York City Federal Court, family members of 11 passengers have joined with family members of ten passengers that filed the first lawsuit in the United States against ExcelAire and Honeywell on November 6, 2006.

“We are committed to holding ExcelAire and Honeywell accountable and obtaining the full compensation permitted under the law for the spouses, children and families of loved ones who died in this terrible tragedy,” explained Leonardo Amarante, whose law firm in Brazil is working in partnership with Lieff Cabraser.

“The Federal court has scheduled a status conference for parties in the case on December 18, 2006,” stated Lexi Hazam, attorney at Lieff Cabraser.

“We will be present in court on behalf of our clients, as will attorneys for ExcelAire and Honeywell. This will provide the families of the Gol Airlines disaster the first opportunity to advance their case before an American court and press for discovery of all facts surrounding the accident.”

The firm notes that one hundred and forty eight passengers and six crew members died on September 29, 2006, when the Gol Airlines aircraft plunged nose-first into the Amazon rainforest after colliding with the ExcelAire aircraft. The firm claims that the lawsuit seeks compensatory and punitive damages against ExcelAire and Honeywell for their negligence -- even though no investigative body has established any responsibility for any aspect of the accident and while international issues further cloud what is expected to be a somewhat difficult investigation.
