SCOTUS Asked To Hear Flight Path Case

Connecticut AG Asks For Review Of Court Of Appeals Decision

Connecticut Attorney General Richard Blumenthal filed a formal petition Tuesday seeking a review by the U.S. Supreme Court of a Court of Appeals ruling allowing flight path changes over the state. The new routes will send more large aircraft over the southwestern part of Connecticut.

The Weston Forum of Connecticut reports that the U.S. Court of Appeals for the District of Columbia in June upheld the new flight paths, which Bluemthal, along with local government officials and others, say will increase noise and pollution over the area. The further claim the FAA did not follow its own rules in establishing the corridors.

“The FAA based its new flight paths on defective data concerning noise and traffic — disregarding the impact on millions of residents in the region, and dismissing less damaging alternatives," Blumenthal said. "Our coalition of public officials, environmental advocates and concerned citizens are determined to redirect these flight paths.”

“We are asking the Supreme Court to ground a bad decision — to override the FAA and its failure to follow the law and its own rules,” he continued. “The FAA is flying above the law, enabled by a bad appeals court ruling."
