New Drone Restrictions In Place In Texas

Complexity Of The Statute Makes Compliance Challenging

The Texas legislature this year passed a law which went into effect September 1 that can result in fines for up to $2,000, and the law is reportedly fairly complex, making compliance challenging.

The online news source 101 Corpus Christi reports that the new Texas law allows most flights over private property with the consent of the property owner, as well as flights conducted for professional, academic or scholarly research by many local and military entities.

The restrictions mainly deal with "surveillance and imaging" in certain areas, including over private property. And the definition of "image" is very broadly defined as "any capturing of sound waves, thermal, infrared, ultraviolet, visible light or other electromagnetic waves, odor, or other conditions existing on or about real property in this state or an individual located on that property.” A violation is a Class C misdemeanor. Using those images is a Class B misdemeanor, which carries a maximum penalty of 180 days in jail and a $2,000 fine.

Flight over "critical infrastructure" facilities are also prohibited for all but certain exempt groups. The law was amended in June to include feeder lots, oil and gas facilities, and telecom services to the critical infrastructure list. Another amendment precludes local governments from enacting their own drone laws.
