Drunken Driver Allowed To Plead To Flying An Airplane While Impaired

But He Wasn't Flying And Isn't Even A Pilot

A District Attorney in Fon du Lac County, WI is raising some eyebrows with a plea deal that has allowed a drunk driver to plead no contest to operating an aircraft while intoxicated. The problem is, the driver wasn't flying an aircraft and isn't even a pilot.

But the "creative" solution allows the president of Anthem Blue Cross and Blue Shield of Wisconsin Lawrence Schreiber of Muskego to keep his drivers license after failing three sobriety tests, according to the Milwaukee Journal Sentinel.

District Attorney Daniel Kaminsky said that there were potential evidence problems with the case, and that the plea to the aviation charge was legally solid and resulted in a positive outcome, and that he'd do it again.

Schreiber will still have to pay a fine and be assessed for alcohol abuse, but he keeps his driving privileges. And, if he's ever charged with operating a vehicle while intoxicated again, the charge will count against him. The Wisconsin DMV has changed its system so that such a prior offence can be noted on a person's driving record.
