Class Action Lawsuit Filed Against DJI

Customers Had Issues With Firmware Update For Phantom 2 Drones

A class action lawsuit has been filed against drone maker DJI connected with December, 2015 a firmware update for DJI Phantom 2 drones.

The website Data Privacy + Security Insider reports that, according to the filing, the update affected the cameras on certain Phantom 2 drones, making it impossible for them to record video or take photographs. The plaintiff class alleges that DJI ignored the problem, causing harm to thousands of Phantom 2 drone owners. The charge that the company failed to reimburse them, replace the product, or take responsibility for the faulty firmware update.

According to the complaint: "The lost functionality of the Phantom 2 drones occurred because the defective firmware update created and released by defendants, which critically affected the drones’ range extender and Wi-Fi modules, which are component parts of the drones.”

The lead plaintiff is Kevin Sives of Pennsylvania. He hopes to represent a nationwide class, as well as a subclass of Pennsylvania residents, of everyone who purchased a Phantom 2 or Phantom 2 Vision + drone who downloaded the DJI Vision firmware update in December 2015. He is seeking general and punitive damages and attorney's fees, as well as a court order to compel DJI to repair or recall the Phantom 2 drones.
