Court Denies Request For Preliminary Injunction Against Eclipse Aviation

Aviace Suing Planemaker For Breach Of Contract

A lawsuit against Albuquerque, NM-based Eclipse Aviation suffered an early defeat this week, as the United States District Court for the District of New Mexico denied Aviace Limited's request for a preliminary injunction against the very-light-jet manufacturer.

In denying Aviace's request, the court found that "Aviace has not shown a substantial likelihood of prevailing on the merits of any of its claims."  The finding concluded with "Therefore, Aviace's Application for Preliminary Injunction must be denied."

As Aero-News reported, Swiss start-up company Aviace is suing the company, after it says Eclipse first delayed, then cancelled, a 112-plane order the company says it made four years ago.

Aviace alleges the situation is all about money -- that Eclipse deliberately cancelled the order, so it could sell the same planes to another customer at greater profit.
