Australian Woman To Be Medically 'Re-Evaluated' After Witnessing Accident

An Airplane Went Down In Her Daughter's Back Yard, So She Claims 'Traumatization'

A grandmother in Cheltenham in South Australia, will be medically re-assessed following a decision by that country's Supreme Court.

Mina Mikham claims she was "traumatized" when a small plane went down in her daughter's back yard in August, 2008. The aircraft had been involved in a mid-air collision. The Cessna 150 impacted the ground just a few yards from the family. The pilot, an Indian trainee identified as Akash Ananth, was conducting his first solo flight. He was killed on impact. The other airplane was able to land safely at nearby Moorabbin Airport. Ananth was praised posthumously for narrowly missing an elementary school as his plane went down in an accident which made headlines across Australia.

Two months later, Ms. Mikhman began treatments for "psychiatric injury," according to a report in the Melbourne and Victoria Herald Sun. But last year, a panel of doctors determined that the degree of her "impairment" did not warrant compensation. Still; she filed a lawsuit against the Royal Victorian Aero Club.

Now, Supreme Court Justice Stephen Kay has sided with Mikhman's attorneys and ordered that the woman be reassessed due to a technicality. That medical assessment has not yet been scheduled.
