New Jersey Townhome Development Claims Jurisdiction Over Airspace

Homeowner's Association Says It Can Impose A Fine Of $100

A townhome development homeowners association in Mendham, NJ has passed a resolution banning the flight of model airplanes and drones in the neighborhood.

And they have set fines beginning at $100 for the first offense.

The resolution passed by the association says that "The use of Unmanned Aerial Vehicles, such as model airplanes, drones, and similar devices is prohibited from being used in/above the property and airspace of the association. This prohibition applies to owners, residents, and visitors. Any violation will be considered to be a Second Level and subject to fines as specified (currently $100 for a first offence and $200 for repeat offences).

The board asserts that there have been complaints about UAVs in the community, and that they "represent a safety hazard, an invasion of privacy, as well as a disruption of peace in quiet to which residents have a reasonable expectancy."

The letter was posted to the UAV Legal News and Discussion Facebook page by Randy Hemmel, who says he knows someone who flies in the area and "everyone is very interested and intrigued by his Inspire drone, and he's never received a single complaint."

The FAA has apparently not yet weighed in on this claim of jurisdiction over airspace.
